In accordance with industrial design law, new designs possessing an individual character can be registered.
A design shall be considered to be new if no other identical design has been made available to the public prior to application for registry, or in the event that priority is claimed, before the date of priority.
A design is defined as identical if its features differ only in irrelevant details.
A design is said to possess singular character if the overall impression it produces on an informed user differs from the impression produced on such user from any other design accessible to the public before the date of application for registry, or, if priority is claimed, before the date of priority.
In order to determine if the design possesses individual character, the degree of freedom of the designer in developing the design shall be taken into consideration.
The application for design registration shall contain:
a) A request applying for design registry.
b) Identification of the applicant.
c) A graphic presentation of the design which can be reproduced.
d) Indication of the products for which the design shall be applied.
